1. Scope

These terms govern the use of tutor.new, meaning the website tutor.new, the web app and the apps for iOS and Android. The provider is Sophia Edu Labs GmbH, Zurich ("we"). If a school or school authority uses tutor.new, its contract with us takes precedence over these terms.

2. What tutor.new is

tutor.new is an AI tutor. It practises with you in writing and by voice ("live"), explains, asks follow-up questions, creates exercises from your material and shows you where you stand. Teachers can set up classes, provide material and assignments and see their class's progress. We keep developing tutor.new; individual features may change or be discontinued.

3. You are learning with an AI

The tutor is an AI system, not a person. Its answers are generated automatically and may be incomplete or wrong. Check important results, for example before an exam, and ask your teacher when in doubt. The tutor's feedback and scores are a learning aid, not grades. tutor.new does not replace lessons, nor medical or psychological advice.

4. Account, age and parents

• Most features require an account. Your details must be correct, and you must not share your login. An account belongs to one person.
• If you are under 16, you need the consent of a parent or other legal guardian, unless you use tutor.new through your school.
• Minors may only make purchases with their parents' consent.

5. What is free and what costs money

• Writing with the tutor is free, permanently.
• Live, talking to the tutor, is free up to a free allowance. The app shows how large it is; we may adjust it. For more live time you book a weekly subscription or single live hours.
• Optional extras such as the games subscription or the coin boost are not needed for learning.
• The price shown before purchase applies. An overview is at tutor.new/en/preise. The prices shown are final prices.
• If your school uses tutor.new, the conditions agreed with your school apply.

6. Payment, subscriptions and cancellation

• In the app you pay through Apple's App Store or Google Play, in the browser through our payment provider Stripe. Purchases through Apple and Google are also subject to their terms; invoices and refunds are handled there.
• Subscriptions such as the weekly or the games subscription renew automatically for their term until you cancel. You can cancel at any time where you bought it: in the subscription settings of Apple or Google, or in your tutor.new account. The subscription runs until the end of the paid period.
• Single hours are a one-off payment. They do not renew and do not expire.

7. Right of withdrawal for consumers in the EU

If you live in the EU and buy directly from us in the browser, you may withdraw from the contract within 14 days without giving reasons. The period starts when the contract is concluded. To withdraw, send us a clear statement, for example by email to friedrich@tutor.new or by post to the address in the imprint. You may use the model form below, but you do not have to. It is enough to send your withdrawal before the period ends.

Effects of withdrawal: We refund all payments without undue delay and at the latest within 14 days of receiving your withdrawal, using the payment method you used. If you asked us to start the service during the withdrawal period, you pay a reasonable amount for the part provided until your withdrawal.

For purchases through Apple or Google, their withdrawal and refund rules apply.

8. Teachers and schools

• Teachers can subscribe to tutor.new privately. The conditions shown when ordering apply.
• With schools and school authorities we conclude a separate contract, for pilots and licences, including a data processing agreement. The school is then responsible for its students' data; we process it on the school's behalf and instructions.
• Whoever sets up a class makes sure the students are allowed to use tutor.new, uploads only material they may use, and does not enter sensitive information about students that is not needed for learning.

9. Your content

What you upload, write or say remains yours. You allow us to store and process it as far as necessary to provide tutor.new to you, for example to create exercises from it or to show your teacher your progress. We ourselves do not train AI models on your content. Only upload content you have the necessary rights to.

10. Coins and rewards

Coins and other in-app rewards are game elements without monetary value. They cannot be paid out, sold or transferred. Redeemable rewards are subject to the conditions shown in the app. We may change or end the reward system; rewards already redeemed are not affected.

11. Fair use

Use tutor.new for learning and teaching. In particular, unlawful, offensive or content harmful to minors, attempts to circumvent safeguards or allowances, automated scraping of the service and reselling access are not allowed. In case of violations we may remove content and suspend accounts.

12. Availability

We make sure tutor.new works as reliably as possible but cannot guarantee it. Maintenance, updates or outages at our service providers may cause interruptions.

13. Liability

We are liable without limitation for intent and gross negligence and under mandatory statutory provisions, for example for injury to life, body or health. Otherwise our liability is excluded to the extent permitted by law.

14. Deleting your account and ending the contract

You can delete your account at any time, in the app under Settings → "Delete account" or by email to friedrich@tutor.new. Accounts created by a school are deleted by the school. Running subscriptions are cancelled separately where you bought them (section 6). We may end a contract for good cause, for example for serious violations of these terms.

15. Changes to these terms

We may amend these terms, for example when our offer or the law changes. We announce material changes in advance, in the app or by email. If you do not agree, you can delete your account and cancel running subscriptions.

16. Governing law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Zurich. As a consumer resident in the EU you keep the protection of the mandatory law of your country of residence and may also bring proceedings there.

1. What this is about

This policy applies to the private product of tutor.new: the website tutor.new and the web app and the apps for iOS and Android when you use them yourself. It does not apply to the school version (section 3). It explains which personal data we process, why, who receives it and what rights you have. We comply with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

3. Not for the school version

tutor.new for schools is a separate product and not covered by this policy. It is governed by the contract with the school and the privacy information for schools. If you use tutor.new through your school, please contact your school first.

4. Which data we process

• Account: name, email address or phone number, the identifier of your Google or Apple account if you sign in with it, profile picture. Optional details such as grade, school type, subjects, learning goal, native language and country. School accounts are created by the teacher with the student's name; sign-in works with a code.
• Learning: your messages to the tutor, your voice conversations (speech is converted to text in real time and the transcript is stored), uploaded photos, documents and media, assignments, results and scores, notes and drawings, and summaries of your sessions.
• Camera: if you turn on the camera in a live session, a system analyses the image to recognise certain gestures and stores the result.
• Payments: what you bought and the status of your subscriptions. Card and account details are processed by Apple, Google and Stripe; we do not see them in full.
• Usage and technical data: IP address, device and browser details, events in the app (for example which features you use), error reports, and recordings of individual sessions showing what happened on screen (session replay).
• Contact: messages to us and booked calls. For teachers also school and phone number if they give them to us to get access.

5. Why we process them

• to provide tutor.new: your account, the tutor, exercises, progress and the teacher features (contract, Art. 6(1)(b) GDPR);
• to handle purchases and subscriptions and meet statutory retention duties (contract and legal obligation, (b) and (c));
• to find errors, run the service securely and prevent abuse (legitimate interest, (f));
• to understand how tutor.new is used and improve it (legitimate interest, (f); on the website partly with consent, (a), see section 8);
• to communicate with you, for example sign-in codes, support or appointments (contract and legitimate interest).

6. Artificial intelligence

So that the tutor can answer, listen and speak, your messages, your voice and your uploads are sent to the AI providers listed in section 7. They generate answers, convert speech to text and text to speech, and read documents. We ourselves do not train AI models on your content. To fix errors and check quality, we log this processing on our own servers in Germany and delete these logs after 30 days. The tutor's feedback and scores are a learning aid; your teacher decides on grades.

7. Who receives the data

We use the following service providers. They process the data on our behalf and only as far as needed for their task. We do not pass on data for advertising.

Data is also disclosed to authorities where we are legally required to do so.

Transfers abroad: Many of these providers are based in the USA or process data there. From the Swiss and EU perspective, the USA only offers adequate protection where the provider is certified under the Data Privacy Framework. Where that is not the case, we base the transfer on the European Commission's standard contractual clauses, which the Swiss Federal Data Protection and Information Commissioner (FDPIC) has recognised.

8. On this website

• Server logs: when you visit the website, our host Vercel processes technically necessary data such as IP address, time and page requested, to deliver and secure the site.
• Fonts and media are loaded from our own servers, not from Google.
• Google Analytics: we use Google Analytics to measure how the website is used. Google sets cookies and receives your IP address, possibly also in the USA. If you visit from a country of the EU or the EEA, we ask for your consent first. Otherwise measurement runs and you can switch it off at any time. You change or withdraw your choice via "Cookie-Einstellungen" here or at the bottom of every page. We store your choice in your browser.
• Booking: the "Book a call" page embeds the Cal.com calendar. When you open that page or book, Cal.com receives your IP address and the details you enter. The call takes place via Zoom.

9. How long we keep data

• We keep your account and learning data for as long as your account exists.
• If you delete your account, we immediately remove your sign-in and profile data and your profile picture. Conversations, uploads and results remain stored without your name. If you want them deleted too, write to us and we will delete them.
• We delete logs of the AI processing after 30 days.
• We keep payment records for as long as the law requires, in Switzerland ten years.

10. Children and parents

tutor.new is also used by children. Anyone under 16 needs their parents' consent, unless their school uses tutor.new. Parents can exercise their child's rights under section 11; write to us at the address above.

11. Your rights

You can request access to your data, have it corrected, deleted or its processing restricted, object to processing and receive your data in a common format. You can withdraw consent at any time with effect for the future. Write to us at friedrich@tutor.new. You can also lodge a complaint with a supervisory authority: in Switzerland the FDPIC, in the EU the authority of your country of residence.

12. Security

Connections to tutor.new are encrypted. Only people at our company who need access to personal data for their work have it.

13. Changes

We update this policy when our offer or the law changes. The version published here applies.
